Networks Terms of Service:
BY ACCEPTING THIS AGREEMENT, YOU AGREE TO WAIVE
AND HOLD ISOLATE NETWORKS HARMLESS FROM ANY CLAIMS
RELATING TO ANY ACTION TAKEN BY ISOLATE NETWORKS
AS PART OF ITS INVESTIGATION OF A SUSPECTED VIOLATION
OF THIS AGREEMENT OR AS A RESULT OF ITS CONCLUSION
THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED.
THIS MEANS THAT YOU CANNOT SUE OR RECOVER ANY
DAMAGES WHATSOEVER FROM ISOLATE NETWORKS AS A
RESULT OF ISOLATE NETWORKS DECISION TO REMOVE
MATERIAL FROM ITS SERVERS, WARN YOU, SUSPEND OR
TERMINATE YOUR ACCOUNT, OR TAKE ANY OTHER ACTION
DURING THE INVESTIGATION OF A SUSPECTED VIOLATION
OR AS A RESULT OF ISOLATE NETWORKS CONCLUSION
THAT A VIOLATION HAS OCCURRED. THIS WAIVER APPLIES
TO ALL VIOLATIONS DESCRIBED IN THIS AGREEMENT.
1) Use and Misuse of the Services
You are expected to use the Internet
with respect, courtesy, and responsibility, giving
due regard to the rights of other internet users.
We expect you to have a basic knowledge of how
the Internet functions, the types of uses, which
are generally acceptable, and the types of uses,
which are to be avoided. If you are not sure if
your actions will be an abuse, violation or misuse,
please ask first: abuse@isolate.net. You agree
to use the Services only for lawful purposes,
in compliance with all applicable laws. Illegality
includes, but is not limited to, drug dealing;
attempting without authorization to access a computer
system; pirating (distributing copyrighted material
in violation of copyright law, specifically MP3s,
MPEGs, ROMs, and ROM emulators); gambling; schemes
to defraud; trafficking in obscene material; sending
a message or having content that is obscene, lewd,
lascivious, filthy, or indecent with intent to
annoy, abuse, threaten, or harass another person;
threatening bodily harm or damage to individuals
or groups; violating U.S. export restrictions;
stalking; or violating other state or federal
law, such as the Electronic Communications Privacy
Act, the Computer Fraud and Abuse Act, or the
Economic Espionage Act. Linking to illegal material
is also prohibited.
2) Use and Misuse of Materials
Materials in the public domain (e.g., images,
text, programs) may be downloaded or uploaded
using the Services. You may also re-distribute
materials in the public domain. You assume all
the risks regarding the determination of whether
the material is in the public domain.
You are prohibited from storing, distributing
or transmitting any unlawful material through
the Services. Examples of unlawful material include,
but are not limited to threats of physical harm,
child pornography, and copyrighted, trademarked,
and other proprietary material used without proper
authorization. Pornography and sex related merchandising,
or links to such material, even if legal, are
not acceptable uses of Isolate Networks servers.
You may not post, upload or otherwise distribute
copyrighted material on Isolate Networks servers
without the consent of the copyright holder.
3) System and Network Security
Violations of system or network security are prohibited,
and may result in criminal and civil liability.
Examples include, but are not limited to the following:
Unauthorized access, use, probe, or scan of a
systems security or authentication measures, data
or traffic. Interference with service to any user,
host or network including, without limitation,
server broadcast messages or any message sent
on an intrusive basis to any directly or indirectly
attached network; attempts to circumvent any user
authentication or security of host, network, or
account; accessing data not intended for user;
probing the security of any network; spawning
dozens of processes; port scans, ping floods,
packet spoofing, and forging router information;
denial of service attacks, sniffers, flooding,
spoofing, mail bombing, ping bombing, smurfs,
winnuke, deliberate attempts to overload a system
and broadcast attacks, forging of any TCP-IP packet
header or any part of the header information in
an email or newsgroup posting, land and teardrop;
promulgation of viruses; and IRC bots, such as
eggdrop or BitchX.
You agree that the security of your account is
solely your own responsibility. You further agree
that if you believe the security of your account
has been compromised in any way, you will notify
Isolate Networks immediately in writing by registered
mail, return receipted, to Isolate Networks, P.O.
Box 986, Chardon, Ohio 44024. You shall be held
fully responsible for any misuse or compromise
to your account for which Isolate Networks is
not properly notified. You agree that if any security
violations are believed to have occurred in association
with your account, Isolate Networks has the right
to suspend access to the account pending an investigation
and resolution. You also agree that Isolate Networks
has the right to cooperate in any government or
legal investigation regarding any aspect of our
services, including services sold to you. Any
use of our system to engage in software piracy
or other violations of law will result in account
suspension and be immediately reported to the
appropriate authorities.
4) Misuse of System Resources
It is a violation for anyone to post information
or to include programs on web space provided through
Isolate Networks services which consume excessive
bandwidth, CPU time or storage space.
5)
Spamming
Sending
unsolicited mail message, including, without limitation,
commercial advertising and informational announcements,
is explicitly prohibited. A user shall not use
another site's mail server to relay mail without
the express permission of the site.
It
is contrary to Isolate Networks policy for customers
to use our servers to effect or participate in
any of the following activities:
1.
To post any Usenet or other newsgroup, forum,
e-mail mailing list or other similar group or
list articles which are off-topic according to
the charter or other owner-published FAQ or description
of the group list;
2. To send unsolicited mass e-mailings,
if such unsolicited e-mailings provoke complaints
from the recipients;
3. To engage in any of the foregoing
activities using the service of another provider;
but channeling such activities through an Isolate
Networks provided server, or using an Isolate
Networks provided server as a mail drop for responses;
4. To falsify user information
provided to Isolate Networks or other users of
the service in connection with use of an Isolate
Networks service.
6) Payment Policy
You agree that you as the person legally responsible
for use of this account and are at least 18 years
of age. You agree to supply Isolate Networks with
a current and truthful name, postal address and
telephone number for our records, and you have
a continued obligation to keep this information
current. You also agree that you are an authorized
user of any credit card that you supply to us
and agree that we have an obligation to fully
investigate any possible fraudulent credit card
use. Your account will not be activated until
we receive your first month's payment. When submitting
a credit card, you must be the card owner. If
this is found otherwise, your account could be
placed on grounds of termination. By submitting
a credit card on the order form, the cardholder
agrees to authorize all recurring charges to the
account, and any balances incurred due to overage
limits, additions of extras to the account, service
charges, and/or any other fees due. To halt the
automatic charging to your credit card, you must
notify our billing department (billing@isolate.net)
at least one week in advance. Users, who have
chosen a billing method other than credit card,
will receive invoices that are sent via email
approximately one week before they are due. Invoices
are to be paid on or by the date on the invoice.
Failure to comply will result in your account
being suspended. If you then wish to re-activate
the account, penalty charges may apply. If at
any time your account becomes far past due or
inactive for any reason, we reserve the right
to terminate the account.
7) System and Network Uptime
Isolate Networks will not be responsible for any
damages your business may suffer. Isolate Networks
makes no warranties of any kind, expressed or
implied for service we provide. Isolate Networks
disclaims any warranty or merchantability or fitness
for a particular purpose. This includes loss of
data resulting in delays, no deliveries, wrong
delivery, and any and all service interruptions
caused by Isolate Networks and its employees.
Isolate Networks will make access available to
you on a best-effort basis. Service outages can
occur over which we have no control. In the event
that an outage lasts more than 24 hours, we will,
at your request, prorate the applicable portion
of your monthly, quarterly, semiannually, or yearly
service charge. Although our average system uptime
is outstanding, we cannot and will not make any
guarantee of any kind regarding the stability
or uptime of this service.
8) Early Termination/Cancellation
Isolate Networks reserves the right to cancel
a customer's service at any time. If cancellation
is caused by customer's violation of these policies,
then no refund is due. Customers may cancel service
at any time, but no refund is due. Isolate Networks
will not offer refunds whatsoever.
9) Service Changes
This agreement supersedes any written, electronic,
or oral communication you may have had with Isolate
Networks or any agent or representative thereof,
and constitutes the complete and total agreement
between the parties.
Isolate Networks reserves the right to change
prices, policies, and configuration of any and
all accounts when deemed necessary. Any violations
of these policies represent a breach of your contract
with us, and your account will be removed from
our system without warning.
10)
Acknowledgement
By
placing and continuing to maintain or place information
on Isolate Networks servers you are stating and
acknowledging that you have read the aforementioned
terms and conditions and that you understand such
terms and conditions and agree to be bound by
them. |
